REPRESENTATIVE APPELLATE CASES

Mandel v. Town of Orleans, 326 F.3d 267 (1st Cir. 2003).

In an appeal to the First Circuit Court of Appeals, Mr. Campbell successfully overturned a federal court injunction barring a Town, its Police Chief and two officers from enforcing child custody orders issued by Maryland and Massachusetts courts. The federal trial court judge later recused himself, and Mr. Campbell obtained dismissal of the entire case against his clients.

In a case before the Massachusetts Appeals Court, Mr. Campbell successfully obtained dismissal of a civil rights lawsuit against his client, who had been sued by a former co-worker. The Appeals Court ordered the other party to pay the legal costs incurred by Mr. Campbell’s client.


OTHER REPRESENTATIVE CASES

Civil Rights

  • Mr. Campbell obtained complete dismissal of a federal civil rights lawsuit filed against his clients, a Massachusetts Town, its Police Chief and a senior officer. The plaintiff was a Connecticut high school principal who alleged that he had suffered serious consequences after a police report concerning his behavior was sent to his school department employer. Mr. Campbell filed a motion to dismiss the case. The federal court ruled that Mr. Campbell’s clients had not violated any laws and that the plaintiff had failed to prove his damages claims.

Employment Law

  • Mr. Campbell successfully defended the Board of Trustees of a Boston church in two successive cases filed against the Board by the congregational leader of the church. After obtaining dismissal of both cases, Mr. Campbell represented and counseled the Board and church congregation in the process of terminating the leader.
  • Negotiated a substantial severance package for a client who had more than twenty years of service with her employer.
  • Obtained a favorable severance package for a disabled employee.
  • Successfully defended a Boston church in litigation filed by a former employee.

Construction Law

  • Shortly after a Massachusetts Town completed a $2 million renovation of its historic town hall, a flood destroyed the Town’s municipal government computer systems and damaged parts of the building. Mr. Campbell sued a construction company responsible for the flood and obtained full reimbursement for all of the Town’s damages, including repayment of the Town’s legal fees.

Business Law

  • Advised a start-up business that designs digital audio engineering equipment for the radio and television industries. Counseled its CEO and management team from the start-up phase to the profitable sale of the company several years later.
  • Represented an owner of a construction company in the dissolution of the business after a long-time partner retired and filed litigation against the company.
  • Counseled an international language school based in the U.K. in establishing operations in Massachusetts, New Jersey and Arizona.
  • Negotiated a significant equipment and services contract for a local recycling company with a major national Styrofoam container corporation.
  • Counseled a business aviation group in forming a Delaware LLC.

Personal Injury

  • Obtained a favorable settlement for a mother of three who was rendered a quadriplegic after an accident.

Estate Planning

  • Successfully represented one branch of a local family in a long-running dispute over an inheritance. This dispute included five separate lawsuits filed by the other side of the family in several different courts. Mr. Campbell litigated all five cases and successfully obtained dismissals of all of them.
  • Drafted estate plans for a number of local families.
  • Enabled the sole surviving heir of a veteran who had died without a will to gain prompt access to his bank account.
